These Terms & Conditions apply to photography services provided by Tochi Itanyi Photography (“the Photographer”) to the person or persons booking the services (“the Client”).
By booking the Photographer, the Client confirms that they have read and agreed to these Terms & Conditions.
1. Services
The Photographer agrees to provide the photography services described in the Client's booking confirmation, invoice or agreed package (“the Services”).
The Services may include photography coverage, image selection and editing, and delivery of the final images. The specific coverage, deliverables, package, location and delivery timeframe will be confirmed in writing at the time of booking.
2. Booking & Payment
A booking is confirmed once the required booking fee has been paid and the Photographer has confirmed the booking in writing.
The booking fee is non-refundable and is applied towards the total cost of the Services.
The remaining balance must be paid by the date stated on the booking confirmation or invoice. For weddings, the balance is due no later than two weeks before the wedding date unless otherwise agreed in writing.
The Photographer reserves the right to withhold delivery of images or suspend the Services where outstanding payments remain unpaid.
3. Cancellation & Rescheduling
Client cancellation
The booking fee is non-refundable if the Client cancels the booking.
Where additional payments have been made, any refund will be considered on a case-by-case basis, taking into account the notice given and any costs or losses incurred by the Photographer.
Rescheduling
Requests to reschedule are subject to the Photographer's availability.
For portrait and couple sessions, one rescheduling may be permitted without an additional fee where reasonable notice is provided. Further rescheduling may incur an additional charge.
Wedding dates may only be rescheduled where the Photographer is available on the proposed alternative date. A new booking may be required where the original date cannot be transferred.
Force majeure
Neither party will be responsible for failure to perform their obligations where this is caused by circumstances beyond their reasonable control, including serious illness, accident, severe weather, government restrictions, venue closure or other circumstances that could not reasonably have been prevented.
Where possible, the Photographer will make reasonable efforts to reschedule the Services or provide a suitable alternative.
4. Photographer Illness, Emergency & Equipment Failure
The Photographer will make every reasonable effort to provide the Services personally.
In the unlikely event that the Photographer is unable to attend due to serious illness, emergency or another circumstance beyond their reasonable control, the Photographer will make reasonable efforts to arrange a suitable replacement photographer or alternative arrangement.
If the Services cannot be provided and no suitable alternative can be arranged, the Photographer's liability will be limited to a refund of payments made for the Services that could not be provided.
The Photographer carries professional equipment and takes reasonable precautions against equipment failure. However, the Photographer cannot guarantee that equipment failure, technical problems or circumstances outside their control will never occur.
5. Copyright & Ownership
All photographs created by the Photographer remain the Photographer's intellectual property and are protected by copyright under the Copyright, Designs and Patents Act 1988.
Copyright is not transferred to the Client unless expressly agreed in writing.
The Client receives a personal, non-exclusive licence to use the delivered photographs for the purposes described in these Terms & Conditions.
The Photographer retains the right to make the final artistic and technical decisions regarding the editing and presentation of the photographs.
RAW or unedited files are not included unless expressly agreed in writing.
6. Client Usage Rights
Unless otherwise agreed in writing, the Client may:
download and store their delivered photographs;
print the photographs for personal use;
share the photographs on personal social media accounts;
use the photographs for personal, non-commercial purposes.
When sharing photographs online, the Client is encouraged to credit Tochi Itanyi Photography where appropriate.
The Client must not, without the Photographer's prior written permission:
sell or license the photographs to another person or organisation;
use the photographs for commercial advertising or promotional purposes;
submit the photographs to publications, competitions or commercial campaigns on behalf of a third party;
materially alter, filter or edit the photographs;
remove any copyright or photographer credit where one has been provided.
Commercial usage may be agreed separately in writing and may incur an additional fee.
7. Photographer's Portfolio & Promotional Use
The Photographer may use photographs created during a session or wedding for their portfolio, website, social media, advertising, marketing, competitions, publications and professional showcases.
For weddings and other private events, the Client should notify the Photographer before booking if they do not wish their photographs to be used publicly.
Where a Client requests that their images remain private, this will be confirmed in writing and respected by the Photographer.
The Photographer will not knowingly identify or publicly disclose sensitive personal information about the Client in connection with the photographs.
8. Image Selection, Editing & Delivery
The Photographer will select and edit the final images at their professional discretion.
The Client acknowledges that not every photograph taken during a session will be delivered. Unedited, duplicate, test or technically unsuitable images will not form part of the final gallery.
The final photographs will be edited in the Photographer's established style. Requests for extensive additional editing or major alterations may incur an additional fee.
The expected delivery timeframe will be communicated at the time of booking.
For weddings, the standard full-gallery delivery timeframe is 4–6 weeks, unless otherwise agreed in writing.
Images will normally be delivered through a private online gallery or digital download.
RAW, unedited files are not included in standard packages.
9. Image Storage & Archiving
The Photographer will make reasonable efforts to retain the Client's final images for a period following delivery.
However, the Client is responsible for downloading and securely backing up their photographs once they have been delivered.
The Photographer is not responsible for permanently storing images after the stated archive period and cannot guarantee that galleries or files will remain available indefinitely.
10. Client Responsibilities
The Client agrees to:
provide accurate information relevant to the booking;
arrive on time and be ready for the agreed start time;
cooperate reasonably during the photography session;
obtain any permissions required for photography at the chosen venue or location;
inform the Photographer in advance of any restrictions, accessibility requirements, sensitivities or important moments that may affect the photography;
ensure that any children or other participants are appropriately supervised.
The Photographer will not be responsible for missed photographs resulting from lateness, lack of cooperation, venue restrictions, changes to the agreed schedule, or circumstances outside the Photographer's reasonable control.
For weddings, the Client is responsible for ensuring that the Photographer is informed of any venue-specific photography restrictions before the wedding day.
11. Wedding Coverage & Timings
For wedding bookings, the Photographer will work according to the coverage and timings agreed in the booking confirmation.
Wedding days can change unexpectedly. Where additional coverage is requested, and the Photographer is available, additional hours may be charged at the applicable rate.
The Photographer will make reasonable efforts to capture the key moments communicated in advance, but cannot guarantee any particular photograph or moment, as circumstances, timing, access, lighting, weather, guest behaviour, or other factors may prevent it.
12. Limitation of Liability
The Photographer will carry out the Services with reasonable care and skill.
To the extent permitted by law, the Photographer's total liability arising from the Services will be limited to the total amount paid by the Client for the relevant Services.
The Photographer will not be liable for indirect or consequential loss arising from circumstances outside their reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
13. Model & Likeness
The Client confirms that they have authority to arrange photography of themselves and, where applicable, any participants they are responsible for.
Where the Photographer has permission to use images for portfolio, marketing or promotional purposes under Section 7, this may include identifiable photographs of the Client and other participants.
The Client is responsible for informing relevant participants of the photography and any agreed usage arrangements where appropriate.
14. Privacy & Data Protection
Personal information provided to the Photographer will be handled in accordance with applicable UK data protection legislation and the Photographer's Privacy Policy.
Personal information may be collected and stored for the purposes of providing the Services, communicating with the Client, processing payments, maintaining business records and fulfilling legal obligations.
Photographs may be securely stored for business, archival and agreed promotional purposes.
15. Governing Law
These Terms & Conditions and any agreement between the Photographer and Client shall be governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales, unless otherwise required by law.
16. Entire Agreement
The booking confirmation, invoice, agreed package and these Terms & Conditions together form the agreement between the Photographer and Client.
Any changes to the agreed Services or these Terms & Conditions must be confirmed in writing.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
